South Carolina Halts Tax Foreclosures for Twelve (12) Months

   James “Jim” Meeks, CTLP®CEO, MTAG ServicesChair, NTLA Legislation CommitteeMember, NTLA Board On September 30, 2020, South Carolina Governor Henry McMaster signed into law House Bill 3755 with the subject title, “Auto Insurance Coverage.” Ninety-nine percent of the bill deals exclusively with auto insurance; however, a rider that was added only one week prior to passage extended the redemption period for the 2019 tax sale by an additional 12 months. 

The NTLA has built a coalition to challenge Act No. 174 (formerly SC HB 3755), and a two-pronged attack is being made. First, a petition has been filed with the South Carolina Supreme Court. Second, a lawsuit has been filed at the trial court level seeking a similar ruling that the Act is unconstitutional.  

We will keep our membership apprised of significant updates, and any unforeseen obstacles, such as this surprise special purpose legislation, that underscores the importance of having a viable trade organization for the tax sale space. We appreciate your support and membership, and we will be there for you if and when you need us.

Beware, the greatest volume of delinquent property taxes will occur in 2021. The NTLA estimates 2021 will have over $25 billion in delinquent property taxes nationally.
